However, if your doctor explained that the treatment is new, or still being tested, and you agree to it, then there is no malpractice. 


When a medical professional does not pay attention to you, your problem, or what they are doing while treating you, it is neglect. You should have their undivided attention so they are capable of treating you correctly. If they have been drinking, taking any drugs, or obviously stressed, they should not be trying to treat you.

If you end up being cured or having the condition brought under control by what was done, it will not win in court.
