If your doctor fails to diagnose a disease, illness, or condition that another professional would have found during the normal diagnostic tests, you may have a malpractice situation. However, if you talk with a second doctor and show them the tests you took and the results and they are able to diagnose your problem, you need to contact a lawyer.

Wrong Treatment

Not all doctors will treat things the same exact way. However, if your doctor gives you a medication or treatment that other medical professionals would disagree to, there is a problem. However, if your doctor explained that the treatment is new, or still being tested, and you agree to it, then there is no malpractice. 

Neglect

When a medical professional does not pay attention to you, your problem, or what they are doing while treating you, it is neglect. You should have their undivided attention so they are capable of treating you correctly. If they have been drinking, taking any drugs, or obviously stressed, they should not be trying to treat you.

Keep in mind that in order to have a medical malpractice case there must be some type of damage done. If you end up being cured or having the condition brought under control by what was done, it will not win in court. You should also keep in mind that medical professionals are human too, and accidents do happen. If the doctor can prove they did what they truly thought was best for you, it is not malpractice.
